EstHR CONFIDENTIAL TRUST PRACTICE

Welcome to my website!
As an external, independent and certified confidential advisor, I help boards of companies comply with the Legislation and have good policies to prevent undesirable behaviour. These include aggression and violence, intimidation, bullying, discrimination and sexual harassment, integrity violations or abuses at work.
At the same time, I help the employees of those companies if they, despite good policies, experience undesirable behaviour, to find the right solution.

Who am I?

I am Esther Visser, I have over 30 years of experience in various HR leadership roles such as HR Manager and HR Director in various industries such as hospitality, retail, development NGO and entertainment. Through my work, I have extensive experience in conducting interviews with employees and executives and advising company boards and works councils on working conditions, among other things.

I enjoy helping employees and organisations to provide clarity and find solutions to difficult situations. My experience enables me to put myself in another person’s shoes and I am an excellent listener, mediator and connector.

What do I do for employees?

It is important to know that the company you work for must have a contract with me.

If an employee wants to talk to an independent person about a situation involving Inappropriate Behaviour (IB) or Integrity Violation (I), I can be reached by phone on working days between 09:00 and 21:00.
I can also be reached in the evenings and weekends. You can always reach me by e-mail. Check my contact details at the bottom of the website.
If I am busy and you get my voicemail, please try another time or leave a message and I will call you back.

After the initial contact, I usually make a separate appointment to take the time to listen to the reporter’s story. This can be done:

by phone – this is often the first contact.
online – via MS Teams, so we can also see each other.
physically – together, we decide on the location where we will talk.

LISTEN

Without judgement and with my full attention to the story, an employee can tell me about the work situation.

SUPPORT

Provide mental support to deal with the feelings the employee is experiencing.

EXPLORE

Explore possible solution routes and follow-up steps, while informing about the consequences of each route.

GIVE CONTROL

Leave the control with the employee; We discuss the possible solutions, and the consequences of each, but the employee decides how to handle the situation.

ASSIST

Upon request, I can assist the employee in preparation and implementing the chosen route.

When am I NOT the right person to speak to?

When you experience private problems. I will offer a listening ear but for an appropriate solution I will refer you to other channels for help, because private issues are not the VP's responsibility nor expertise. The VP helps purely with situations arising at work in the field of inappropriate behaviour and integrity.

If you disagree with an assessment or performance interview, disagreement with the organisation's policy (e.g.: reorganisation) and labour conflicts, we first investigate together whether there is inappropriate behaviour or integrity violation displayed. If not, I refer to the appropriate expertise.

I do not listen to both sides of an argument, I do not conduct investigations and I do not search to find the truth.

Employers, organisations and leadership teams

I make myself known within the organisation and develop information materials.

I deliver presentations and lectures that inspire and inform teams and organisations about legal and professional developments on the subject of working conditions.

I signal trends to the employer/organisation, and report them anonymised.

I provide requested and unrequested policy advice, to all management levels, Works Council and HRM departments.

Every year, the organisation receives an annual report from me, containing advice.

 

My contact person within the organisation is usually the managing director and/or the HR manager/director.

Legal and judicial framework

In the Netherlands, it is regulated by Law that organisations must do two things:

Ensure a socially safe working environment. This is determined by the Ministry of Social Affairs and Employment. The legal instruments are in the Working Conditions Act and in the Psychosocial Workload (PSA) policy.

Ensuring an integrity based organisation. This is determined by the Ministry of Home Affairs and Kingdom Relations. The legal instruments are in the Statutory Whistleblower Regulations and in the organisation's reporting procedure.

Having a Confidential Advisor will become mandatory by 2025 for companies with 10 employees or more.

FIXED COST PER YEAR: € 500,-

Availability for employees and employers Mon-Fri between 09:00 and 21:00.

Availability for employees on Saturday and Sunday between 14:00 and 17:00.

An annual report for the company with anonymised numbers and types of reports and advises for the future.

Intermediate unrequested advice on the PSA policy in your company if a trend emerges from reported behaviour.

I will send the invoice upon entering into the agreement.

Variable Cost per year

The time I spend on the initial reporting by the employee and any further counselling of the employee is not included in the fixed costs per year. I invoice these according to my hourly rate. For travel expenses I charge € 0,23 per kilometre (which I limit as much as possible by working by phone and through MS Teams or choosing a meeting location that is easily accessible). All costs are excluding VAT.

What else do I do?
HR assignments

I am also available for temporary HR assignments such as:

  • Setting up a training Academy.
  • Replacing an HR director/manager/Sr. HRBP temporarily.
  • Setting up an onboarding process.
  • Conducting a Leadership training course.
  • Conduct an HR training course for a group of entry-level managers.
  • Being a case manager to supervise complicated absence cases.

 

Again, I work on the basis of an hourly rate excluding VAT and travel expenses at € 0,23 per kilometre.
